Terms of Service

1. Purpose
These terms of service and sale (the “Terms”) govern access to and use of the Respark service (the “Service”), an online application that helps local businesses manage their reputation: collecting customer reviews, AI-assisted drafting of replies to reviews, and displaying social proof via a widget. By creating an account, you accept these Terms in full.
2. Service publisher
The Service is published by Respark. For any question regarding these Terms, you may contact us at the address shown on the site. Full legal information (company name, registration number, host) is to be completed by the publisher before going live.
3. Account and eligibility
The Service is reserved for professionals acting within their business activity. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity carried out from your account. Authentication is done via a magic link sent to your email address.
4. Trial, plans and billing
The Service offers a 14-day free trial with no credit card required. After the trial, access to paid features requires a subscription (Starter, Pro or Multi-location). Payments are processed by our provider Stripe; we never store your card details. Subscriptions are monthly, renew automatically, and can be cancelled at any time from the billing area. Cancellation takes effect at the end of the current period; no pro-rata refund is due for the period already started, except where mandatory law provides otherwise.
5. AI-generated replies
The Service offers automatically drafted reply suggestions. These suggestions are provided for guidance only: you remain solely responsible for the content you publish. We recommend reviewing and approving each reply before publishing. Respark does not guarantee the accuracy, relevance or error-free nature of generated content.
6. Acceptable use
You agree not to misuse the Service, in particular by: publishing fake reviews, soliciting reviews in exchange for an advantage in a way that breaches platform rules (Google, etc.), sending unsolicited messages, or using the Service for unlawful purposes. Any breach may lead to suspension or termination of the account without notice.
7. Availability and liability
We use reasonable means to keep the Service available, without guaranteeing uninterrupted operation. To the extent permitted by law, Respark’s liability is limited to the amounts actually paid over the last twelve months. Respark cannot be held liable for business decisions made on the basis of the Service or for content published by the user.
8. Intellectual property
The Service, its brand and its software components remain the property of Respark. You keep ownership of your data (reviews, requests, business information). You grant us a limited licence to host and process it strictly as needed to operate the Service.
9. Personal data
The processing of personal data is described in our privacy policy, which forms an integral part of these Terms.
10. Changes to the Terms
Respark may update these Terms. You will be informed of any material change; continued use of the Service constitutes acceptance of the new Terms.
11. Governing law
These Terms are governed by French law. Failing an amicable resolution, any dispute will fall under the jurisdiction of the courts of the publisher’s registered office, subject to the mandatory rules applicable to consumers.
